1. Agreement to Terms
By accessing or using the Belle Body website and/or purchasing the “10-Week Belle Body Plan” or any associated product (digital download, printed spiral-bound guide, bonus materials), you (“you”, “client”, “user”) agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not use the website or purchase the product.
2. Services Provided
Belle Body provides (a) a digital program (PDF, videos) and (b) optionally a printed + digital bundle, comprising exercise routines, time-trial scorecards, illustrative guides, bonus challenges, and access to support/community. The program is designed for general fitness and well-being; it is not personalised medical, diagnostic or treatment advice.
3. Eligibility
You represent and warrant that you are at least 18 years of age or the legal age in your jurisdiction to form binding contracts and that you have full legal capacity to agree to these Terms. If you are under 18, you must obtain consent from a parent or guardian.
4. General Disclaimer
You acknowledge and agree that:
The Program is not medical, psychological, nutritional, or dietary advice. It is general fitness content only.
You should consult your physician, dietician, or an appropriate health professional before beginning any exercise program, especially if you are pregnant, postpartum, have a medical condition (including but not limited to heart disease, high/low blood pressure, asthma, joint problems, diabetes, osteoporosis), are under medical supervision, or using medication.
Use of the Program is entirely at your own risk. Neither Belle Body, its instructors, affiliates nor licensors will be liable for any injury, health condition, damage or loss incurred as a result of using the Program.
By participating in the Program you assume full responsibility for your actions and ensuing results.
4b. Medical, Dietary & Pregnancy Disclaimer
The Belle Body Plan does not replace medical, dietary, or physiotherapy advice.
It is not tailored to your individual medical history or dietary needs.
Pregnant or postpartum women should obtain medical clearance before beginning any exercise program.
If you have specific conditions (e.g., heart disease, diabetes, high blood pressure, joint injuries), you must receive personalised guidance from a health professional.
5. Your Responsibilities
You agree to:
Use the Program according to your own fitness level and modify or skip exercises as necessary.
Stop any exercise if you feel pain, dizziness, shortness of breath, or any other adverse reaction, and consult a medical professional if necessary.
Ensure any equipment you use is in good condition, safe and appropriate; provide your own equipment unless otherwise stated.Follow proper warm-up, cool-down, hydration, and rest protocols as recommended. Keep all login/payment credentials secure. Not share your access or resell the Program.
6. Intellectual Property
All content in the Program (documents, videos, images, logos, downloads, graphics) is the property of Belle Body or its licensors and is protected by copyright, trademark and other intellectual property laws. You are granted a non-exclusive, non-transferable licence to use the Program for your personal, non-commercial use only. You may not reproduce, distribute, publicly display, modify, sell or exploit any part of the Program or make it available to others without express written permission.
7. Payments, Refunds & Guarantee
The Digital Download product is offered at the price listed on the website at the time of purchase.
The Printed + Digital Bundle is supplied at the listed price plus shipping (if applicable).
You may be eligible for the 100% Money-Back Guarantee if you complete the Program (all sessions) and track your results (scorecards/photographs) within the 10-week period but still do not feel “fitter, stronger or more confident”, subject to our verification process.
The guarantee does not apply if you fail to follow the program properly, alter or abandon the schedule, or do not submit required documentation.
Refund requests must be submitted within 30 days after completion of the Program via email to [email protected].
We reserve the right to deny a refund if misuse, fraud or breach of these Terms is evident.
All fees are non-refundable after the guarantee period or for printed orders once dispatched/used.
8. Limitations of Liability
To the fullest extent permitted by law:
Belle Body, its officers, directors, employees, agents and affiliates shall not be liable for any direct, indirect, incidental, consequential, special or punitive damages arising out of or relating to your use of or inability to use the Program, including but not limited to loss of profits, data, business interruption, or personal injury.
Maximum aggregate liability (if any) shall be limited to the amount you paid for the Program.
This limitation applies whether based on contract, tort (including negligence), statute or otherwise.
Some jurisdictions (including parts of the USA) may not allow exclusion or limitation of certain damages; in such cases liability will be limited to the greatest extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless Belle Body and its affiliates from and against any claims, actions, demands, losses, liabilities, costs or expenses (including legal fees) arising out of your breach of these Terms, your use of the Program, your violation of any law or rights of a third party.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts of Melbourne, Victoria.
If you are a resident of the United Kingdom, these Terms are governed by English law and you submit to the non-exclusive jurisdiction of the English courts.
If you are a resident of the United States, these Terms are governed by the laws of the relevant State in which Belle Body conducts business (Victoria, Australia) and you submit to the non-exclusive jurisdiction of the courts of the Commonwealth of Australia.
For other jurisdictions, any dispute will be governed by Australian law and determined in the courts of Victoria, unless prohibited by local law.
11. Termination & Access Rights
We reserve the right to suspend or terminate your access to the Program at any time, with or without cause, including if you breach these Terms. On termination, all licences granted to you will end and you must cease all use of the Programs. Sections relating to Intellectual Property, Disclaimer, Limitation of Liability, Indemnification and Governing Law survive termination.
12. Changes to the Program or Terms
We may modify or discontinue (temporarily or permanently) the Program, change pricing, or amend these Terms at any time. For material changes to the Terms we will post the change on the website and update the “Effective Date”. Your continued use after such changes indicates your acceptance of the new Terms. We recommend you review these Terms periodically.
13. Privacy
Your use of your personal data is governed under our Privacy Policy which forms part of these Terms.
14. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by Belle Body on the Website, constitute the entire agreement between you and Belle Body relating to your purchase and use of the Program. They supersede all prior or contemporaneous communications and proposals (electronic, oral or written).
15. Waiver & Severability
No waiver by Belle Body of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition. If any provision of these Terms is held to be invalid or unenforceable under applicable law, such provision shall be deleted and the remaining provisions shall survive and remain enforceable.
16. Community & Social Media Content
Any testimonials or transformation photos shared on social media represent individual experiences and may not reflect typical results. Participation in the Belle Body online community or social media challenges is voluntary.
By posting or tagging #bellebody or @belle_pt, you grant Belle Body permission to repost your content for marketing, provided it is respectful and compliant with platform rules.
17. Equipment Safety
Users are responsible for ensuring:
Equipment (e.g. mats, dumbbells, steps) is in good condition and used according to manufacturer instructions.
Adequate floor space and environment are clear of hazards.
Proper hydration, warm-up, and cool-down are maintained.
